GMC consultation on dealing with cases at the end of an investigation

Title: Reform of the fitness to practise procedures at the GMC: Changes to the way we deal with cases at the end of an investigation

Date: April 2011

Summary: The consultation proposes an alternative to sending the majority
of fitness to practise cases to a public hearing. The proposals involve greater discussion with doctors to encourage them to accept the measures appropriate for public protection

While we are generally in favour of the principles behind these proposals – namely exploring proportionate and cost effective ways to deal with fitness to practise cases – we consider that public confidence in the GMC’s regulatory process will only be maintained if there is adequate transparency of decisions made about doctors’ fitness to practise. There is a risk that public confidence could be harmed if decisions taken by GMC staff are not subject to independent external scrutiny, particularly if detailed reasons are not published.
